Hak Asasi Manusia

Pada lazimnya, hak asasi manusia adalah berdasarkan kepada perisytiharan yang dibuat oleh Perhimpunan Agung Pertubuhan Bangsa-Bangsa Bersatu (UN) pada 10 Disember 1948. Perisytiharan ini yang dikenali sebagaiPerisytiharan Hak Asasi Manusia Sejagat (UDHR) telah membahagikan hak asasi manusia kepada empat kebebasan utama iaitu:

1. kebebasan daripada ketakutan
2. kebebasan daripada kemahuan
3. kebebasan bersuara
4. kebebasan kepercayaan.

Ia menyenaraikan pelbagai hak asasi manusia, daripada hak sivil dan politik sehinggalah hak ekonomi, sosial dan kebudayaan.

Hak Asasi Manusia adalah asas kepada kewujudan manusia dan kewujudan bersama manusia .Hak Asasi Manusia bersifat sejagat.Menurut Kamus Dewan hak asasi ialah hak yang dasar atau pokok seperti hak bebas mengeluarkan pendapat, menganut sesuatu agama, bergerak dan lain-lain. Contoh yang diberi itu sebenarnya hanya merujuk kepada makna tradisi hak asasi manusia. Dengan perkembangan zaman, makna hak asasi harus diberi tafsiran yang lebih meluas.

     Antara hak-hak individu ialah seperti hak hidup, makan, minum, pakai, milik, belajar, bersuara, rawatan, bekerja, warganegara dan sebagainya. Tetapi apabila bertembung antara hak individu dengan hak masyarakat, maka hak masyarakat mestilah didahulukan selagi tidak melanggar hak individu yang lebih besar.Di Eropah dan Barat, mereka mengutamakan hak individu. Bagi mereka, setiap individu berhak melakukan sesuatu perkara yang diinginkannya, selagi perkara itu tidak mengganggu privasi orang lain.Lantaran itu, atas "tiket" hak individu, muncul pelbagai kontroversi yang mencabar nilai sosial masyarakat di sana. Antara hak individu yang mencetuskan kontroversi adalah membenarkan perkahwinan sejenis dalam kelompok gay dan lesbian, begitu juga hak mereka untuk mempunyai anak dengan pasangan masing-masing walaupun tidak berkahwin.Bagi masyarakat Timur termasuk Malaysia, hak dan nilai masyarakat mengatasi hak peribadi. Individu di negara ini tidak boleh sesuka hati melakukan perkara yang bertentangan dengan nilai masyarakat.

     

     Manusia adalah makhluk sosial sebagaimana dikatakan oleh ilmuwan moden. Seseorang akan sedikit nilainya kalau dia sendirian, dan akan banyak nilainya kalau dia bersama sama orang ramai.Bahkan dianggap tiada ketika dia sendirian. Atas dasar itu, kewajiban yang berkaitan dengan hak orang ramai atau umat harus lebih diutamakan daripada kewajiban yang berkaitan dengan hak individu. Hak ramai antaranya hak jiran tetangga,hak rakan, ketenteraman awam, kesihatan awam , Hak berhimpun secara aman dan hak berpesatuan.
